By creating an account or using Connect America App ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These Terms form a legally binding agreement between you ("Customer") and Connect America Application LLC, a New Jersey limited liability company ("Company," "we," "us").
Connect America App is a cloud-based field service management platform that helps businesses manage jobs, clients, employees, scheduling, dispatching, invoicing, route optimization, and SMS communications. The Service is provided on a subscription basis.
You must provide accurate, complete information when creating your account. You must verify your email address before your account is fully activated. You are responsible for all activity that occurs under your account and for maintaining the security of your credentials. One company account may include multiple employee or admin users. You must be at least 18 years old to create an account.
Current plans: Starter $39/mo (up to 5 employees), Professional $89/mo (up to 15 employees), Business $179/mo (unlimited employees).
New accounts receive a 14-day free trial. No credit card is required during the trial. After the trial ends, you must select a paid plan or the Free plan to continue using the Service.
You agree not to use the Service to:
You own all data you input into the Service, including client records, job information, employee data, invoices, and communications ("Customer Data"). We do not claim any ownership rights over Customer Data. By using the Service, you grant us a limited license to store, process, and transmit your Customer Data solely to provide and improve the Service.
By using features that send SMS messages (job notifications, appointment reminders, client communications), you consent to receive service-related text messages. Standard message and data rates may apply. You may opt out of SMS notifications in your account settings.
You are responsible for ensuring that your clients have provided proper consent to receive SMS messages before sending through our platform, in compliance with the Telephone Consumer Protection Act (TCPA) and all applicable laws. Recipients may reply STOP to opt out at any time.
Your use of the Service is governed by our Privacy Policy, incorporated into these Terms by reference.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CONNECT AMERICA APPLICATION LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Connect America Application LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any illegal or harmful activity conducted through your account, including unauthorized SMS messaging.
We may suspend or terminate your account for violation of these Terms, non-payment, or at our discretion with 30 days' notice. You may terminate your account at any time. Upon termination, you may request a data export within 30 days before your data is permanently deleted.
All content, features, and functionality of Connect America App — including text, graphics, logos, and software — are owned by Connect America Application LLC and protected by applicable intellectual property laws. You may not copy, modify, or distribute our materials without written permission.
These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in New Jersey. You consent to personal jurisdiction in those courts and waive any objection to venue.
We may update these Terms from time to time. We will notify you by email or in-app notice at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Connect America Application LLC regarding the Service and supersede any prior agreements.
